Construction work under the Construction (Design and Management) Regulations 2007 means 'the carrying out of building, civil engineering or engineering construction work'.

What is path construction work under the CDM Regulations?

Before answering the question, it's necessary to understand first - what is 'construction work' under the CDM Regulations, particularly if you work in the field of either forestry work or countryside management work, and do not associate 'construction work' with your particular project work activities.

The CDM Regulations provides us with a definition of what 'construction work' means - 'the carrying out of building, civil engineering or engineering construction work'. The definition is very broad and includes:

  • The construction, alteration, conversion, fitting out, commissioning, renovation, repair, upkeep, redecoration or other maintenance, de-commissioning, demolition or dismantling of a structure.

  • The preparation for an intended structure, including site clearance, exploration, investigation (but not site survey) and excavation, and the clearance or preparation of the site or structure for use or occupation at its conclusion.

  • The assembly on site of prefabricated elements to form a structure or the disassembly on site of pre-fabricated elements, which immediately before such disassembly formed a such structure.

  • The removal of a structure or part of a structure or any product or waste resulting from demolition or dismantling of a structure or from the disassembly of pre-fabricated elements, which immediately before such disassembly formed such a structure.

  • The installation, commissioning, maintenance, repair or removal of mechanical, electrical, gas, compressed air, hydraulic, telecommunications, computer or similar services, which are normally fixed within or to a structure.

So, what is path construction work under the CDM Regulations?

Provided below are some examples of path construction work and associated structural work that are 'construction work' under the definition of the CDM Regulations. These examples should help you to identify if your proposed path construction project involves 'construction work'.

  • Constructing a new path with or with out structures such as resting places, passing places etc.

  • Re-alignment, extending, repairing, replacing, upgrading and re-constructing an existing path including any associated structures.

  • Constructing and erecting a new bridge, boardwalk, large sculptures or interpretation board shelter.

  • Maintaining, repairing and demolishing or dismantling part of an existing bridge, boardwalk, large sculptures or interpretation board shelter.

  • Constructing a new car parking area.

  • Extending, repairing, replacing, upgrading and re-constructing an existing car parking area.

  • Constructing, maintaining and repairing a new pond including dipping platform.

  • Extending, restoring or re-constructing an overgrown pond.

  • Putting in a temporary access route for hauling materials onto a path construction site.

  • Felling and clearing site vegetation along route in preparation for path construction work.

  • Marking path line before construction work starts.

  • Positioning and erecting site accommodation, welfare and plant and equipment storage units including necessary site security fencing.

  • Excavations for drainage features, earthworks and to form path formation tray.

  • Digging trial holes for investigating suitability of on-site materials for building a path.

  • Erecting or dismantling entire or part of a prefabricated bridge, boardwalk, large sculptures or interpretation board shelter.

  • Disposal of entire or part of a bridge, boardwalk, large sculptures or interpretation board shelter.

  • Removal of site accommodation, welfare and plant and equipment storage units including necessary site security fencing on completion of path construction works.
